We are not afraid to develop innovative and original strategies and pursue meritorious claims or defenses simply because to do so calls for the extension of current law, or a unique perspective on the facts at issue. Just that occurred beginning in 1997 in Mr. Osherow's handling of the Stoffer v Hernandez medical malpractice and managed care liability litigation. This case, to our knowledge, was the first we are aware of in Florida where, based upon our unique development of the facts, a Miami State court jury held an HMO's medical clinic accountable for the mismanagement of the care rendered to one of its members. The Appellate Court upheld the jury's findings, and the Court awarded Attorney fees and costs, together with almost $1.3 Million Dollars. After that, the area of HMO litigation has greatly expanded. Since that time the firma has expanded its representation into business litigation and the defense of employment law matters, in which the firm has developed considerable experience. Under the guidance of Mr. Osherow, the firm is also proud of its work in the products liability arena. In 2005, Mr. Osherow was named in a top "up and comer" by the South Florida Legal Guide in the area of products liability as well as in business litigation, an area of practice in which Mr. Osherow has since been certified as a specialist by the Florida Bar. Together with his partner, David Shiner, the firm is confident and prepared in its ability to continue its tradition of undertaking complex representations in these practice areas.

BILLING RATES
Our standard billing rates are generally $3575 per hour for senior level attorney time (19+ years experience) [Mark R. Osherow], $275 per hour for sny other partner time and $175 through 225 for associate's time and $75.00 per hour for paralegal time.

However, it is the firm's policy to negotiate a fair fee rate and any alternative arrangements with each individual client. We consider the amount of legal work, the number of cases generated by the client, and the length and quality of the client relationship, as well as other factors in determining the client's billing rate and a fair fee for our services.
